This Promotion is promoted by FERGULF TRADING UAE L.L.C., Dubai, UAE (the "Promoter"). All participants to this Promotion (“Participants”) shall be subject to these Terms and Conditions.

Promotion Dates

This Promotion starts from 1st of April 2025 until 31st of April 2025 and it will take place across United Arab Emirates. 

Eligibility

Subject to the provision below, this Promotion is open to individuals above 18 eighteen years old who are legally residing in the  United Arab Emirates .

Employees of the Promoter, its subsidiaries, divisions, affiliates, authorized dealers/distributors, agents and their immediate family members are not eligible to enter the Promotion. Promoter reserves the right to disqualify any such person from receipt of any prize and/or require the return of any prizes awarded. In such an event, and subject to any legal requirement, the Promoter reserves the right to select a new winner for the prize and/or dispose of the prize in any manner it deems fit, in its sole discretion. 

Participants may be required to provide proof of identity and residence in the form reasonably requested by the Promoter.

Participation in this Promotion and the content of these Terms and Conditions are subject to restrictions as may be contained in the laws and regulations of the Emirate of Dubai and the United Arab Emirates.

Participation & Submission

Upon purchasing 30 AED of the below Kinder products, participants can scan the QR code on the point of sales stand and be directed to WhatsApp chat to participate in the Promotion.

The Participants will have to submit a picture of their receipt, to get a chance to win one of the prizes mentioned below:

Participants have to provide the following details to the Promoter: full name, email address, contact details and delivery address in addition to accepting these Terms and Conditions.

Participants who provide incorrect details shall be cancelled from the Promotion.
 

Prizes

Participant has the right to a chance to win only one time. A winner must provide proof of identity to claim the prize and if found that he participated in different identity he will be forfeited, and another winner will be selected instead.

The Promoter reserves the right to alter the dynamics of the prizes due to any unforeseen circumstances.

Winners will participate/ avail of the prizes at their own risk and responsibility and in accordance with the terms and conditions of each of the chosen suppliers within the times and dates set by each supplier.

a)    Promoter's decision is final regarding the winner selection and no challenges and/or correspondence will be accepted  in this regard.

b)    In case of a minor (below 18 eighteen years old), permission must be obtained by guardians of the minor, and the guardians must provide the Promoters with their documents.
 

c)    Prizes awarded in this Promotion may not be exchanged for their value. Promoter reserves the right to substitute any prize for another prize of similar value. Substitution of prizes by the winners is prohibited. In the event any winner chooses not to accept his/her prize, the relevant prize will be deemed forfeited, and Promoter may, subject to applicable laws, select another winner from all of the remaining entries at its discretion. Promoter's decision regarding the award of all prizes, and/or in every situation including any not covered in these Terms and Conditions, shall be final and binding on all Participants.
 

The winner will be communicated with via their email after being selected by the Promoter.  

A time period of 30 days would apply to present or dispatch the gift after announcement.  

d)    The Promoter reserves the right to pass the prize to an alternate winner if the winner did not claim his/her prize within 7 seven days upon communicating with the winner.

e)    The Promoter reserves the right and in their sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminates, modify and/or suspend the contest at any time. Any changes on the contest will become effective upon notice via posting on social platforms that the Promoter is running.

f)    Contestants and Participants agree that personal data including, but not limited to, name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by the Promoter and its subsidiaries, divisions, affiliates, authorized dealers/distributors, agents for the purposes of conducting and administering the Campaign. 

Use of Name and Likeness

Winners hereby grant to Promoter, at no cost, the unconditional, perpetual right and authority to publish and broadcast anywhere in the world, for editorial, advertising, promotional, marketing and/or other purposes and in any media, their name, image, drawing, likeness and/or photograph, except where prohibited by law.

Personal Information

The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to regulatory authorities. Entry and participation in this Promotion is conditional upon Participants' providing this information. The Promoter may, for an indefinite period unless otherwise required by law, use the information for promotional, marketing and publicity purposes including sending electronic messages to the Participant. Participants should direct any request to access, update or correct information to the Promoter. Participant hereby consents to the use of their personal information in the manner set out in these Terms and Conditions and waives their rights to initiate any claim against the Promoter for privacy invasion, improper disclosure of personal information or any other related claims. 

General Terms

By entering this Promotion, Participants warrant that they have read and agree to abide by these Terms and Conditions.

If for any reason this Promotion is not capable of being carried on as planned, due to without limitation infection by any computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, act of God, war (whether or not declared), political coup or insurrection, rebellion, labor dispute, fire, epidemic, storm, flood, typhoon, explosion, legal enactment, government directive, order or regulation, any law or regulation having force of law or any other reason or cause beyond the control of the Promoter, which corrupts or affects the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter, to the fullest extent permitted by law, reserves the right in its sole discretion to cancel, terminate, modify or suspend this Promotion and to disqualify any Participant who tampers with the Promotion and/or the entry process. To the fullest extent permitted by law, the Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer software and/or equipment, failure of any e-mail account or any combination thereof.
 

The Promoter will be entitled at its sole discretion and subject to any applicable law, to terminate or modify the Promotion or to modify these Terms and Conditions at any time prior to the closing date, by posting the revised Terms.

The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any death or personal injury suffered or sustained as consequence of participation in the Promotion, except for any liability that cannot be excluded by law.

Participant, to the fullest extent permitted by law, hereby releases Promoter, and all persons or corporations associated directly or indirectly with the Promotion from all claims, demands and proceedings arising out of their participation in the Promotion. To the fullest extent permitted by law Participant indemnifies Promoter and all persons or corporations associated directly or indirectly with the Promotion against all liability, loss or damage arising out of their participation in the Promotion, including any breach of these Terms and Conditions by them, the content of or infringement of a third parties intellectual property rights in their submitted review. This release and indemnity extend to and includes Promoter, its parent company and its related bodies corporate, and its respective directors, officers, agents, contractors, employees, promoters and sponsors associated with or which is involved directly or indirectly with the Promotion. This release and indemnity continue forever and binds Participants' heirs, executors, personal representatives and assigns.

By participating in this Promotion, Participants accept that any dispute in relation to their participation in the Promotion or the running of the event will be subject to the laws and regulations of the Emirate of Dubai  and the United Arab Emirates. The parties shall at first attempt to settle through amicable negotiations any dispute which arises under these Terms and Conditions. If the dispute remains unresolved within thirty (30) days of either party having resorted to such negotiations, then either party may submit the dispute to the exclusive jurisdiction of the Courts of  Dubai (excluding the courts of the Dubai International Financial Centre (DIFC)), for determination in accordance with the law.
